The Transport Department has informed to all the concerned vehicle owners that as per under sub section (I) and (2) of section 55 of the Motor Vehicles Act, 1988, if a motor vehicle has been destroyed or has been rendered permanently incapable of use, within fourteen days or as soon as may be, the owner is required to report the fact to the registering authority from where it was originally registered and get the registration certificate cancelled.
And under Sub-section (3) of section 55 provides that if the registering authority is satisfied that the vehicle is in such a condition that it is incapable of being used or its use in public places would constitute a danger to the public and that it is beyond reasonable repair, may cancel the registration after giving the vehicle owners an opportunity for making any representation he may wish to make.
Further, it is also observed from vehicle data available on the VAHAN Application that vehicle owners are not coming forward for reporting such matters to get the certificate of registration cancelled.
It stated that this inaction on the part of the vehicle owners is leading to a lot complications and misrepresentations of data such as:
a. Arrears in collection of tax or tax default;
b. Non-compliance to provisions of the MV Act and Rules like plying of unregistered/non-renewed vehicles.
c. Plying of unfit vehicles like non-compliance to fitness test, pollution tests, insurance failure, HSRP not fitted etc.
The department in exercise of the powers conferred under sub section of (3) of section 55 of the Motor Vehicles Act, 1988, all vehicle owners who have not renewed their certificate of registration for 5 years or more, are hereby given 30 days of time from the date of issue of this Office Memorandum for getting the Certificate of registration of their vehicles renewed or get the Certificate of Registration cancelled at the respective registering offices, failing which, the Registering Authorities shall process for cancellation as stipulated under section 55 (3) of the Act, presuming that the vehicle is incapable of being used or its use in public places would constitute danger to the public and that it is beyond reasonable repair.
