CENTRAL MOTOR VEHICLE AMENDMENT RULES

The Ministry of Road Transport & highways had amended the Central Motor Vehicles Rules, 1989 called the Central Motor vehicles (fifth Amendment) Rules, 2022 vide Notification No.GSR 164(E) Dated 25.02.2022 with the objective of bringing in a coordinated effort and for taking prompt action in motor accident claims in the country;

By the Central Motor Vehicles Rules, 1989 called the Central Motor Vehicles (Fifth Amendment) Rules, 2022 vide Notification No GSR 164(E) Dated 25.02.2022 Rule 150A has been inserted wherein the form and manner of maintaining records of every policy of insurance and the procedure for investigation of road accidents are redefined. The responsibilities of all the stake holders involved in the claims for accidental insurance such as Police, the Health Department, the Claims Tribunal, the Transport Department, the Insurance companies and the manner in which the Detailed Accident Report (DAR), the Interim Accident. Report (IAR), the First Accident Report (FAR) are to be filed are incorporated;

For the purpose of ease of doing things and for carrying forward the provisions of the amended rules and in compliance to directive of the Hon'ble High Court of Delhi and the Hon'ble Supreme Court of India, the Ministry had developed a new functional module, the electronic form of the Detailed Accident Report (DAR) known as the eDAR, (erstwhile iRAD) whereby all the features of the amendments made vide the above notification are incorporated into the new module which encompasses all the stakeholders and envisages accelerating the claims procedure in a time bound manner.

Therefore, in the interest of the general public, the Government of Nagaland hereby mandates all stakeholders to ensure that the amendments made to the CMVR, 1989 vide; Notification No.GSR 164(E) Dated 25.02.2022 are strictly adhered to and that the digital platform, e-DAR, developed by the Ministry of Road Transport & Highways, for uniform and speedy disposal of insurance claims throughout the Country in compliance to the directive of the Hon'ble Supreme Court of India are complied with.
